Active defense is typically only discussed as technical operations. This session will instead focus on human-directed countermeasures involving intelligence gathering and reacquisition of stolen data. Using real-world examples and new guidance from DOJ, it will identify legal red lines and policy considerations when gathering information from criminal sources and reacquiring stolen data online.
Pre-Requisites: Basic understanding of the policy debates surrounding active defense. While this presentation will include legal concepts, no prior familiarity of those is required.
