An Existential Crisis for Global Data Flows: Privacy and Security Issues

In July 2020, Europe's highest court invalidated the EU-US Privacy Shield data transfer agreement, throwing trans-Atlantic data flows into flux. This session will address requirements for European data transfers, benchmark security measures and other procedures companies are adopting, such as increased encryption and transparency reports, and advise on how to address security requests.


Learning Objectives
1. Develop an understanding of laws relating to cross-border data transfers, including an awareness of recent European case law concerning trans-Atlantic data transfers.
2. Learn to identify the regulatory risks involved with cross-border data transfers as well as to navigate the challenges posed by business partner diligence requests involving data transfers.
3. Hone understanding of applicable laws and regulations by exploring short, medium, and long-term data privacy and security compliance strategies.
